Terms of Service
Acceptance of Terms: By using Spa Religion’s services – whether booking an appointment through our website or receiving treatments at our MedSpas or via our mobile units – you acknowledge that you have read and agree to these Terms of Service. If you do not agree, please do not use our services or website. Spa Religion’s services include wellness and aesthetic treatments (such as IV hydration therapy, hormone therapy, skincare services, laser treatments, injectables, and related offerings) provided in the U.S. and internationally. These Terms apply to all users of our services, except where specific local laws supersede (for example, certain consumer rights in the EU as noted below).
No Medical Emergencies & No Guarantees: Spa Religion is a medical spa and not an emergency medical provider. Our services are not intended for emergency or life-threatening conditions. In a medical emergency, call 911 or seek immediate in-person care – do not rely on our services for urgent needs. While our licensed healthcare professionals strive to provide high-quality care, we do not guarantee any particular outcome or cure. You agree that no warranties or guarantees have been made to you regarding results of any treatment; all expressions about likely outcomes are opinions only, not medical assurances.
Professional Services & Disclaimer: All treatments are administered by qualified personnel (e.g. physicians, nurse practitioners, registered nurses, aestheticians or other licensed providers). Spa Religion itself facilitates scheduling and coordination, but the medical decisions and care are provided by the healthcare professionals. We do not practice medicine as an entity separate from our providers. Any information on our website or marketing materials is for general informational purposes and is not medical advice. Always consult your personal physician before beginning any new wellness, aesthetic, or therapy program. No content on our site or communications should be taken as a guarantee of compatibility or efficacy – individual results will vary and risks exist for any procedure.
Risks of Wellness and Aesthetic Therapies: You acknowledge that wellness IV drips, injections (e.g. Botox® or fillers), hormone therapies, laser treatments, and other services carry inherent risks. These may include, for example, injection site pain, bruising, bleeding, or infection; allergic reactions; IV infiltration or phlebitis; dizziness or fainting; inflammation or scarring; nerve injury; undesired aesthetic outcomes; and other possible side effects. We provide detailed consent forms and explanations of risks for each treatment (see Consent to Treat below) and you agree that by proceeding with a service, you have been informed of general risks. Spa Religion disclaims liability for any adverse effects or complications not caused by our negligence or willful misconduct. In other words, if you experience a complication despite proper procedures and without any negligence on our part, you agree that Spa Religion is not liable for those outcomes. This does not waive your rights in cases of provider negligence or malpractice; it simply acknowledges that some risks are inherent and accepted by you when consenting to elective wellness and aesthetic treatments.
Not Evaluated by FDA: The treatments and wellness services offered by Spa Religion (including IV nutrient therapies, supplements, and certain off-label uses of medications) may not have been evaluated or approved by the U.S. Food and Drug Administration for specific purposes. These products and services are not intended to diagnose, treat, cure, or prevent any disease. Any reference to vitamins, nutrients, or therapies on our website or materials is for marketing description only and does not imply an FDA evaluation of efficacy. You agree that you understand this distinction. Particularly, some therapies (e.g. uses of FDA-approved medications for wellness or cosmetic purposes) might be considered “off-label.” While our licensed medical providers may, in their professional judgment, recommend off-label uses when appropriate, such custom or off-label
therapies might not have formal regulatory approval for the specific use. By accepting treatment, you knowingly consent to such therapies even if they are not specifically approved by regulatory authorities for that use.
Use of Service – Telehealth and Mobile Services: Spa Religion offers services both in-person at our Georgia MedSpa (and other locations) and via mobile units that come to your location, as well as telehealth consultations where permitted. When you use our telehealth platform or consult with our providers by video, phone, or messaging, you agree to the inherent limitations of telemedicine. Telehealth: You understand that technical issues or missing information can affect virtual care, and that certain conditions may require an in-person exam. Our providers will inform you if an in-person follow-up is needed. By using our telehealth ervices, you consent to receiving care remotely and accept the associated risks and benefits that have been explained to you. For mobile (in-home) visits, you agree to provide a safe, sanitary environment for our staff to administer services, and to disclose if you or anyone at the location has any contagious illness (for example, if you or a household member are exhibiting COVID-19 symptoms, you will inform us in advance) to protect our staff and other patients.
User Responsibilities: You agree to provide accurate and complete health information in your intake forms and communications. Our ability to treat you safely and effectively depends on you disclosing all relevant conditions, medications, allergies, and past adverse reactions. If you withhold or fail to disclose important health information, you assume responsibility for any consequences. (For example, if you do not mention a medication you are taking and it causes an interaction, that risk falls on you.) You also agree to follow any pre- and post-care instructions given to you for your treatments (such as avoiding alcohol before IV therapy, or following skincare protocols after a laser session). Following these instructions is important for your safety and results; failure to do so may increase risk of complications.
Limitation of Liability & Arbitration: To the maximum extent permitted by law, Spa Religion’s liability to you for any claims arising from your use of our services or website is limited. We operate under Georgia state law for U.S. clients, and applicable EU and local laws for international clients. Arbitration Agreement: By agreeing to these Terms, you and Spa Religion mutually agree that any dispute or claim arising out of or relating to these services will be resolved by binding individual arbitration, not in court. You are waiving your right to a jury trial and to participate in any class action or class-wide arbitration for such disputes. This arbitration will be conducted pursuant to the rules of a neutral arbitration organization (and if you are a consumer in the EU or another jurisdiction that does not permit mandatory arbitration or class-action waiver, this clause will apply only to the extent allowed by your local law). No Class Actions: You may only bring claims on your own behalf, and not on behalf of others, and an arbitrator may not consolidate your claim with anyone else’s. We do this to ensure efficient resolution of disputes. We explain the process for initiating arbitration and any opt-out rights in the Consent to Treat or intake documents (and you may opt out of arbitration within 30 days of first agreeing to these Terms if required by law; contact us for details). By continuing to use our services, you indicate your acceptance of this arbitration agreement. If you do not agree, do not use the services.
Governing Law: Except as otherwise provided by mandatory law in your jurisdiction, these Terms of Service and any disputes arising under them are governed by the laws of the State of Georgia, USA (for U.S. clients) and applicable U.S. federal law. International clients agree that Georgia law applies to the extent permissible, and that we aim to comply with applicable local consumer protection and data privacy laws (such as the GDPR for EU residents). Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Severability: If any part of these Terms is found to be invalid or unenforceable, the remainder of the Terms will continue in effect. All provisions are intended to be enforced to the fullest extent of the law. These Terms (along with the Privacy Policy and any applicable consents you sign) constitute the entire agreement between you and Spa Religion regarding the use of our services.
By using Spa Religion’s services, you confirm you understand and agree to these Terms of Service. We are committed to clarity and your satisfaction, and we thank you for choosing Spa Religion for your wellness and aesthetic needs.
Consent to Treat
This Consent to Treat form covers your agreement to receive Spa Religion’s wellness and aesthetic services, whether via telehealth, in-MedSpa, or through our mobile unit. Please read each item carefully. By signing the intake form or acknowledging electronically, you indicate your understanding and consent to each of the following:
1. Informed Consent to Treatment: I understand the nature of the treatment(s) I will receive, including its intended benefits and potential risks. The Spa Religion provider has explained the treatment to me in clear terms, and I have had the opportunity to ask questions. I confirm that I have accurately disclosed my health history, current medications, supplements, and any relevant lifestyle factors. Knowing the risks and benefits, I voluntarily consent to receive the planned therapy or procedure. I understand I can decide to stop any treatment at any time and that my consent is ongoing and can be withdrawn before or during a session.
2. Telehealth Services: If my care involves telehealth consultations (evaluation or treatment via video call, phone, or electronic messaging), I consent to receive care through these remote communication technologies. I acknowledge that telemedicine has limitations compared to in-person care, including possible gaps in physical examination and the risk of technical problems or security breaches. The provider has discussed with me the risks and benefits of telehealth, and I accept those risks. I also agree to be in a private, safe environment during telehealth sessions and will inform the provider of my location (in case emergency services need to be called). I understand that if I experience an urgent or emergent medical issue during a telehealth encounter or thereafter, I should seek emergency in-person care or call 911, as Spa Religion’s telehealth is not for emergency medical situations.
3. Mobile and In-Home Treatment: If I am receiving services via Spa Religion’s mobile IV unit or in-home visits, I agree to ensure a safe environment for the provider to work (clean, with a place for the provider to set up equipment). I understand that I am assuming the risk of having treatments performed outside a MedSpaal setting. This includes potential exposure to or from the provider of communicable illnesses. I will inform Spa Religion before my appointment if I or someone at the location has any contagious illness (e.g., COVID-19, flu) or if I have any environmental hazards at my location (such as pets that might interfere, etc.). I understand the provider may decline or reschedule the service if they assess that conditions are not safe or suitable for care.
4. Acknowledgement of Providers: I acknowledge that my care may be rendered by various Spa Religion staff, which can include a physician, nurse practitioner, physician assistant, registered nurse, licensed esthetician, or other qualified personnel, depending on the service. I consent to treatment by these professionals as appropriate to my care. I understand that any medical diagnosis or prescription (for example, for hormone therapy or other medications) will be made by a licensed medical practitioner, and that Spa Religion may have an affiliated physician or medical director overseeing MedSpaal protocols. I authorize the Spa Religion staff to perform appropriate assessments (such as vital signs, physical exam, or telehealth exam) and to proceed with treatments as per their professional judgment. This may include obtaining laboratory tests (with my separate consent), starting IV lines, injecting substances, performing laser or facial treatments, etc., as we have discussed and agreed upon.
5. Risks of Proposed Treatments: The provider has explained to me the specific risks, side effects, and possible complications of the treatments I will receive. These include both common side effects and serious but rare complications. For example:
6. IV Hydration Therapy: Risks include pain, bruising, or infection at the IV site; infiltration of IV fluid into surrounding tissue; allergic reaction to infusions; inflammation of the vein (phlebitis); fluid overload; electrolyte imbalances; or injury to blood vessels or nerves.
7. Injection Therapies (Botulinum toxin, Dermal Fillers, PRP, etc.): Risks include temporary pain, redness, or swelling at injection sites; bruising; asymmetry or unsatisfactory cosmetic result; infection; allergic reaction; for fillers, rare risks like vascular occlusion leading to tissue damage; for neurotoxins, temporary muscle weakness beyond target area.
8. Hormone Therapy (e.g. bioidentical hormones, weight loss injections): Risks include hormonal side effects such as mood changes, blood pressure changes, blood clots (for certain hormone treatments), etc., as well as the specific risks of any medication (for example, Semaglutide injections can cause nausea, GI upset, rare risk of pancreatitis, etc. which were explained to me).
9. Laser and Aesthetic Skin Treatments: Risks include discomfort during treatment, redness, swelling, burns or scarring (rare), pigment changes in skin (darkening or lightening, usually temporary), reactivation of cold sores in laser-treated areas, eye injury (if protective eyewear not used), or lack of desired result.
10. General: Any treatment carries the chance of an unexpected allergic or adverse reaction. I agree that the Spa Religion team has communicated the risks and benefits associated with each treatment I am undergoing and answered my questions to my satisfaction. I acknowledge that no guarantee of specific results has been given, as outcomes can vary between individuals. I freely accept the possible risks and agree to proceed.
11. Off-Label Use and Novel Therapies: I understand that some therapies or products used by Spa Religion may be considered off-label or not specifically approved by regulators for the applied use (for example, certain vitamins or medications used in IV therapy, or medications like Ozempic®/semaglutide used off-label for weight management if not formally approved for that indication). I have been informed that these treatments may not have been reviewed or approved by the FDA or equivalent bodies for the intended wellness/cosmetic purpose. Nevertheless, based on the provider’s explanation and my own judgment, I consent to proceed with these treatments. I understand that “off-label” means the medication or product is FDA-approved for some medical use, but not necessarily the use we are doing; it does not mean the product is experimental or of low quality. I trust the professional judgment of Spa Religion’s medical staff in recommending such use for my benefit, and I accept any increased uncertainties associated with off-label treatments.
12. Privacy and Health Information: I acknowledge that Spa Religion will create and maintain records of my medical history, treatments, and outcomes. I have been offered a copy of Spa Religion’s Notice of Privacy Practices (HIPAA Privacy Notice) and the Spa Religion Privacy Policy (see below) which explain how my protected health information (PHI) will be used and disclosed. I understand that my information will be kept confidential in accordance with HIPAA and applicable privacy laws. I authorize Spa Religion to use and disclose my information for the purposes of treatment, payment, and healthcare operations (for example, sharing necessary information with specialists or laboratories involved in my care, or billing my insurance or payment processor). I also consent to Spa Religion contacting me with appointment reminders or health follow-ups. If I have provided an email or phone number, I consent to receiving communications (voicemail, text, email) regarding my care. I know I can withdraw consent for marketing communications (like newsletters or promotions) at any time, and Spa Religion will not share my identifiable health information with third-party marketers without my explicit permission. (Any use of my data for research or marketing beyond basic communications would be explained to me and subject to separate consent.)
13. Liability Release: I release Spa Religion and its staff from any liability for adverse outcomes or complications that are not due to negligence. This means that if I experience a known risk or an unpredictable reaction that the staff did not negligently cause, I agree not to hold Spa Religion legally responsible. For example, if I have an allergic reaction to a treatment that I did not know about or disclose, or if I develop a bruise or minor infection despite proper care (a risk inherent to injections), I accept that risk as part of my informed consent. However, I retain my rights to seek recourse if I believe there was provider negligence or misconduct. This consent and release do not waive my protections as a patient under law; they simply acknowledge my understanding of which outcomes are considered an accepted risk of treatment versus those caused by substandard care.
14. Arbitration Agreement: (If not already covered in Terms of Service) I understand that any disputes arising from the treatment or this consent will be handled as outlined in the Spa Religion Terms of Service arbitration clause. By consenting to treatment, I agree to resolve disputes through mediation and/or binding arbitration instead of court, and to waive any right to a jury trial or participation in class actions, to the extent allowed by law. I understand this does not apply to filing a complaint with regulatory bodies or any non-waivable legal rights, but covers civil claims between me and Spa Religion. I have the right to opt out of this arbitration agreement by notifying Spa Religion in writing within 30 days if I choose (for U.S. clients). International clients: Spa Religion will abide by any mandatory laws about dispute resolution in your country, and the arbitration clause will be adapted as needed to comply with those laws.
15. Patient Responsibilities: I agree to follow post-care instructions and to contact Spa Religion for any concerning side effects or questions. I will seek emergency care for serious reactions or if I cannot reach Spa Religion in a timely manner for urgent issues. I will also inform Spa Religion of any changes in my medical condition before future treatments. I acknowledge that medicine is not an exact science and that results can vary, and thus I will maintain realistic expectations and communicate openly with the providers.
By signing the Spa Religion Consent to Treat form (electronically or in print), I confirm that I understand all the above items. I have had the chance to ask questions, and all my questions have been answered to my satisfaction. I understand that I may receive a copy of this consent form upon request. I freely consent to the proposed treatments under the conditions outlined above.
